Torkornoo’s Removal Driven More by Politics Than Law – Dr Zaato

A political science lecturer at the University of Ghana, Dr Joshua Jebuntie Zaato, has argued that the removal of former Chief Justice Gertrude Araba Torkornoo was influenced more by partisan political interests than purely constitutional procedures.

Speaking on The KeyPoints show on TV3 on Saturday, October 18, 2025, Dr Zaato maintained that while the Constitution provides the framework for such removals, the actual implementation is largely determined by political will and rational self-interest of the sitting president.

Despite the political undertones, Dr Zaato noted that the former Chief Justice’s decision to challenge her removal in court has triggered spirited legal debates that could strengthen Ghana’s jurisprudence.

“There are certain questions we would never have been forced to confront if she had not pushed the matter this far. In the long run, these legal battles will serve as precedents, shaping how future removals of high judicial officers are handled,” he said.

According to him, the evolving discourse will benefit not only lawyers but also political science students and future generations, as it provides deeper insights into the intersection of law and politics in Ghana’s governance system.

“Something tells me this is not the last time a Chief Justice will be removed, and certainly not the last time one will challenge the process. When it happens again, there will be precedents and rulings to guide how they are done,” Dr Zaato concluded.
