President Mahama Refers Petitions Against Chief Justice to Council of State

President John Dramani Mahama has officially forwarded three petitions seeking the removal of Chief Justice Gertrude Torkonoo to the Council of State, initiating the constitutional process for review.

The decision, which aligns with Article 146 of the 1992 Constitution, was announced on Tuesday, March 25, 2025, in a statement issued by Felix Kwakye Ofosu, MP and Minister for Government Communications.

According to the statement, the president is committed to following due process in handling the matter and ensuring that the petitions are considered in line with legal provisions.

“His Excellency the President, in adherence to Article 146 of the 1992 Constitution, has submitted the petitions to the Council of State for the necessary consultation process to commence,” the statement read.

Article 146 outlines the procedure for the removal of a Chief Justice or other Justices of the Superior Courts, requiring a petition to be submitted to the President, who must then refer it to the Council of State. If the Council advises that there is a prima facie case, the President will set up a committee to investigate the allegations.

While details of the allegations remain undisclosed, the petitions have reportedly been submitted by multiple individuals, signalling growing concerns over the Chief Justice’s conduct or decisions in office.
