Private legal practitioner and former Member of Parliament (MP) for Berekum, Captain (RTD) Nkrabea Effah Dartey, has cast doubt on the credibility of the Operation Recover All Loots (ORAL) report as a basis for prosecution.
His remarks follow the official presentation of Phase I of the ORAL report to President John Dramani Mahama.
In an interview with Channel One News on Monday, February 10, Effah Dartey contended that while the report may serve as a reference point, it cannot legally be used to prosecute individuals.

He asserted that the document is merely a guide to call individuals for questioning rather than a legally binding piece of evidence.
Effah Dartey criticised the establishment of ORAL, arguing that President Mahama set up the initiative hastily in a bid to bolster his anti-corruption image.
According to him, the constitutional state agencies vested with prosecutorial powers will ultimately take charge of any legal proceedings.
“In less than two months, Operation Recover All Loots (ORAL) has come up with a report. I wonder what is in the report because nobody, nobody, mark my words, nobody, not even the Attorney General, can rely on the report to prosecute anybody,” he asserted.
His remarks highlight concerns over whether ORAL’s findings hold substantial legal weight or whether they serve as a mere political tool.
Effah Dartey stressed that the due process of prosecution must be upheld by the appropriate constitutional bodies, reinforcing the notion that ORAL’s operations lack legal enforceability.
Effah Dartey further emphasised that the country’s legal framework assigns prosecutorial duties to established state institutions such as the Attorney General’s office and the Special Prosecutor.
He reiterated that any legal action stemming from corruption allegations must go through these bodies rather than relying on the findings of a hastily constituted investigative body.
