Court of Appeal to Rule on Anas’ Unmasking Order on January 30, 2025

The Court of Appeal has scheduled Thursday, January 30, 2025, to deliver its ruling on the prosecution’s appeal challenging the High Court’s directive for investigative journalist Anas Aremeyaw Anas to unmask in front of Kwasi Nyantakyi before testifying in open court.

The decision comes after the parties were instructed to submit their written arguments by December 16, 2024. The three-member panel, led by Justice Anthony Oppong and including Justices Kweku Tawiah Ackaah Boafo and Aboagye Tandoh, will decide on the matter, which will determine the next steps in the case before the High Court.

This legal dispute stems from a May 17, 2023 ruling by the High Court, which granted a request from the defence team of Nyantakyi, former president of the Ghana Football Association (GFA), to have Anas unmask privately before him in chambers prior to testifying while masked in court.

However, Anas, a key witness in the trial of Nyantakyi and Abdulai Alhassan for fraud, rejected the ruling, preventing the trial from moving forward. The state subsequently filed an appeal, and the case now awaits the Court of Appeal’s judgement.

At the High Court on January 14, 2025, the case was adjourned to February 13, 2025, after a request by the defense. Lawyer Baffour Gyau Bonsu Ashia explained that the trial was on hold pending the Court of Appeal’s decision.

Nyantakyi and Alhassan face charges of fraud and conspiracy in connection with Anas’ investigative exposé, Number 12. Both have denied the charges and remain out on bail.
