Court Halts Swearing-in of Akwatia MP-elect Ernest Kumi
The Koforidua High Court has granted an interim injunction preventing Ernest Kumi from being sworn in as the Member of Parliament-elect for the Akwatia constituency in the Eastern Region.
Mr. Kumi, the New Patriotic Party (NPP) candidate, was declared the winner by the Electoral Commission (EC) three weeks ago after a contentious electoral process.
The final results, announced at the National Police Training School in Tesano, Accra, showed Mr. Kumi securing 19,269 votes against 17,206 votes for Henry Boakye-Yiadom of the National Democratic Congress (NDC).
However, the NDC’s parliamentary candidate, Mr. Boakye-Yiadom, has challenged the results, filing a lawsuit against the EC, Ernest Kumi, and the Clerk to Parliament.
The suit seeks to halt Mr. Kumi’s recognition as the Member of Parliament for Akwatia until the dispute is resolved.
The court’s ruling, issued on Thursday, ordered all parties involved to refrain from proceeding with Mr. Kumi’s swearing-in. It stated:
“The respondents, their representatives, agents, servants, and all privies are restrained from proceeding to call, admit, register, swear in, recognise, or gazette the 1st respondent (Ernest Kumi) as the elected Member of Parliament for the Akwatia constituency.”
Additionally, Mr. Kumi has been directed to cease presenting himself as the Member of Parliament for the constituency. The injunction will remain in effect for 10 days.
