Three Petitions Seek Removal of Special Prosecutor Kissi Agyebeng Over Alleged Incompetence, Misconduct and Conflict of Interest
Three separate petitions demanding the removal of Special Prosecutor Kissi Agyebeng have been submitted to President John Dramani Mahama, alleging incompetence, financial mismanagement, conflict of interest, and dereliction of duty.
The petitions filed by the Coalition for Integrity in Governance (COFIIG), Apostle Abraham Lincoln Larbi, and a third citizen whose identity remains undisclosed are calling for action under Section 15 of the Office of the Special Prosecutor Act, 2017 (Act 959) and Article 146 of the 1992 Constitution.
The most extensive petition, presented by Simon Yaw Awadzi, Executive Chairman of COFIIG, alleges that Mr Agyebeng has failed to account for more than GHS364 million in budgetary allocations to the Office of the Special Prosecutor (OSP) since 2021.
According to the group, no audited financial statements have been published over the period.

COFIIG further claims that the Special Prosecutor has shown “consistent underperformance”, pointing to the absence of significant corruption convictions or major asset recoveries despite the office’s substantial resourcing. This, they argue, amounts to incompetence and a failure to meet the OSP’s core anti-corruption mandate.
The petition also alleges misconduct, including claims that Mr Agyebeng withheld investigative dockets from the Attorney-General for months, reportedly delaying the extradition processes involving former finance minister Ken Ofori-Atta.
Additionally, COFIIG raises questions of conflict of interest, claiming that the Special Prosecutor’s nomination was influenced by a powerful figure in the previous administration, thereby casting doubt on his neutrality.
The group is requesting a forensic audit of OSP accounts and wants Mr Agyebeng to step aside pending the investigation.
A second petition filed by Apostle Abraham Lincoln Larbi, who recently led a small protest alongside private legal practitioner Martin Kpebu, accuses the Special Prosecutor of conspiring with Ken Ofori-Atta to help him evade justice.
The petition also claims that the Special Prosecutor disrespected the Attorney-General by refusing to release the docket on Mr Ofori-Atta, a position that mirrors concerns raised by COFIIG.
According to sources within Citi News, the third petition focuses entirely on the Strategic Mobilisation Ghana Limited (SML) matter.
It alleges that the Special Prosecutor failed to exercise his police powers to arrest Ken Ofori-Atta and instead allowed him to leave the jurisdiction. The petitioner also claims Mr Agyebeng issued misleading public statements regarding requests for support from security agencies.
The petition argues that such conduct is “immoral” and undermines public trust in the OSP’s ability to combat corruption.
Collectively, the petitions assert that the continued stay of Kissi Agyebeng in office threatens transparency, accountability and effective governance.
The Presidency has not yet issued an official response to any of the petitions, though sources suggest the submissions have been acknowledged and are being reviewed in accordance with constitutional procedures.
