NDC Appeals High Court Ruling on Mandamus Applications in Disputed Constituencies

The National Democratic Congress (NDC) has filed a notice of appeal at the Court of Appeal, contesting the Accra High Court’s ruling on the mandamus applications brought by the New Patriotic Party (NPP).

On January 4, 2025, the High Court ordered the Electoral Commission (EC) to complete the collation of results for the disputed constituencies of Tema Central, Ablekuma North, Okaikwei Central, and Techiman South by January 6, 2025.

The ruling followed mandamus applications filed by NPP candidates, compelling the EC to finalise the results collation in these areas. Justice Forson Agyapong, who presided over the case, outlined the legal basis for granting the applications, emphasising that:

  • A public duty must exist.
  • A demand for its performance must have been made and refused.
  • Substantial prejudice must have resulted from the failure to perform the duty.

The court directed the Inspector General of Police to provide armed security during the collation to ensure safety and order.

The NDC’s appeal challenges both the January 1 and January 4, 2025, rulings, arguing:

  1. The High Court overstepped its jurisdiction.
  2. The rulings are inconsistent with electoral laws and procedures.
  3. The expedited collation could undermine fairness and transparency in the process.
