A High Court Judge in Kumasi, Her Ladyship Justice Dorinda Smith-Arthur, has questioned the widespread practice of performing both ordinance and customary marriages, describing it as unnecessary and a waste of time and resources.
Justice Smith-Arthur noted that Ghanaian law recognises each marriage type as independently valid, making the duplication of both ceremonies legally superfluous. She made the observation in passing while presiding over a high-profile case involving the late highlife legend Charles Kwadwo Fosuh, popularly known as Daddy Lumba.
The matter, filed by Akosua Serwaa Fosuh, seeks a judicial declaration affirming her as the only lawful surviving spouse of the late musician. The defendants in the case include Abusuapanin Kofi Owusu as the first defendant and Priscilla Ofori, popularly known as Odo Broni, as the second defendant.

All witnesses in the case have now been cross-examined, and the court is expected to deliver its ruling on Friday, November 28, 2025.
The outcome is anticipated to draw significant public interest given the stature of the late musician and the legal questions surrounding marital validity in Ghana.
