Daddy Lumba’s Funeral: Court Adjourns Akosua Serwaa’s Case to Oct. 28

A Kumasi High Court has adjourned to October 28, 2025, the hearing of a legal dispute that could impact the final funeral rites of the late highlife legend, Daddy Lumba, scheduled for December 6, 2025, at the Baba Yara Stadium.

The case was brought before the court by Akosua Serwaa, wife of the iconic musician, who is seeking a declaration as the only surviving spouse and the sole individual legally entitled to perform widowhood rites.

The legal action names Kofi Owusu Fosu, head of Lumba’s external family, and Priscilla Ofori, popularly known as “Odo Broni”, as defendants. Serwaa is challenging what she describes as an attempt to unlawfully sideline her in the funeral arrangements.

During proceedings on Thursday, October 16, lawyers for the defendants filed to challenge the capacity of the plaintiff to bring the case before the court. However, Her Ladyship Justice Dorinda Smith Arthur declined to entertain the objection, noting that the issue was not formally before the court.

Plaintiff’s counsel, William Kusi, countered the challenge, stressing that the main business of the day was to move the injunction application filed earlier.

After hearing submissions, Justice Arthur adjourned the case to October 28, urging both parties to pursue an amicable settlement but adding that the case would be treated as a priority matter if it proceeds.

Lawyers for the defendants also informed the court that they had filed a conditional appearance motion, pending the substantive case. All parties have been directed to file their responses within 14 days.

Akosua Serwaa is seeking an injunction to restrain Odo Broni from publicly presenting herself as the surviving wife of the late musician.

She argues that she is legally married to Daddy Lumba, and neither she nor her children were consulted before the family announced the funeral date, which they allegedly learnt about through social media.

She maintains that her marriage to the music icon remained valid at the time of his death on July 26, 2025, and therefore she holds the exclusive right to perform widowhood rites.

According to her statement, the family head informed her that she would not be allowed to perform the rites, a role traditionally reserved for the legal spouse. She contends that the family’s decision to allow Odo Broni to perform such rites is unlawful, insisting that Broni was never legally married to the late star.

The case threatens to disrupt the highly anticipated funeral, which is expected to draw thousands of mourners, dignitaries, and music lovers from across the country and beyond.

Speaking to journalists, lawyer William Kusi expressed confidence that the matter would be resolved before the funeral date:

“We’re committed to protecting the integrity of Lumba. We’re ready to ensure the date for the funeral comes on,” he stated.

The court’s ruling on October 28 will be crucial in determining who has the legal right to perform widowhood rites and whether the funeral will proceed as planned or face further delays due to the ongoing family dispute.
