Court Clears Path for Ablekuma North Rerun as Injunction Bid Fails

The High Court has dismissed an application by New Patriotic Party (NPP) parliamentary candidate Nana Akua Afriyie aimed at halting a July 11 rerun of parliamentary elections in 19 polling stations in the Ablekuma North constituency.

The ruling, delivered by Justice Ali Baba Abature, described the application for an interim injunction as “unmeritorious”, noting that the Electoral Commission (EC) must be allowed to complete its constitutional duty of ensuring full representation for the people of Ablekuma North.

“The balance of convenience lies in allowing the EC to proceed,” the judge ruled, emphasising the importance of concluding the disputed December 7, 2024, parliamentary election results.

Nana Akua Afriyie had argued that the EC’s decision to organise a rerun violated a High Court judgement delivered on January 4, 2025, which, according to her legal team, ordered the Commission to collate results from 62 polling stations and declare a winner.

Her counsel, NPP lawyer Gary Nimako, referenced a January 27 press release and a parliamentary briefing by Deputy EC Chair Dr Bossman Asare, which he claimed confirmed that only three polling stations remained uncollated at the time.

The court, however, found these arguments insufficient to override the need for a rerun, ruling that the EC’s current actions fall within its constitutional mandate to ensure accurate and fair electoral outcomes.

With the dismissal of the injunction request, the EC is now legally cleared to proceed with the rerun in 19 polling stations. The exercise is expected to break the deadlock in Ablekuma North and finally determine the constituency’s Member of Parliament.

The constituency has been without a parliamentary representative since the contested December elections, and the July 11 rerun is widely seen as the last step in bringing closure to the impasse.
