Supreme Court Rejects Injunction Against Chief Justice’s Removal Process in 3-2 Ruling

The Supreme Court has, in a closely split 3-2 ruling, dismissed an interlocutory application aimed at halting the removal process and reversing the suspension of Chief Justice Gertrude Torkornoo.

The application, filed by Old Tafo MP Vincent Ekow Assafuah and argued by former Attorney General Godfred Yeboah Dame, sought to block President John Mahama from proceeding with actions related to a petition that triggered the Chief Justice’s suspension.

The majority decision was delivered by Acting Chief Justice Paul Baffoe-Bonnie and Justices Yonny Kulendi and Amadu Tanko, who found insufficient grounds to warrant an injunction. Justices Henrietta Mensah Bonsu and Ernest Gaewu dissented, siding with the applicant’s argument for restraint.

Though the court declined the request, it announced that the full reasoning behind its decision will be disclosed on May 21, 2025.

Chief Justice Torkornoo was suspended on April 22 by President Mahama after a prima facie case was established based on petitions submitted by three parties: private citizen Daniel Ofori, senior police officer Ayamga Akolgo, and the civic group Shining Stars of Ghana.

A five-member committee is now investigating the allegations at the heart of the petitions.

Assafuah had attempted to preempt the process by filing the application before the petition was transmitted to the Chief Justice, but the Supreme Court has now cleared the way for proceedings to continue.
