VIDEO: Supreme Court Orders Rehearing of Mandamus Application Over Disputed Parliamentary Results

The Supreme Court has directed that the mandamus application related to disputed parliamentary election results be reassigned to a different High Court judge for rehearing.

The decision comes after the apex court found that the original trial judge violated the National Democratic Congress (NDC) parliamentary candidates’ right to a fair hearing during their initial application.

The Supreme Court also quashed the recollation results for the 2024 parliamentary elections in four constituencies: Tema Central, Ablekuma North, Techiman South, and Okaikwei Central.

However, the court upheld the recollated results for Ahafo Ano North and Nsawam Adoagyiri, leaving them unchanged.

This judgement directly challenges the controversial recollation process carried out by the Electoral Commission (EC) and nullifies the subsequent declarations made for the affected constituencies.

Despite invalidating the recollation results, the court clarified that the mandamus application filed by New Patriotic Party (NPP) parliamentary candidates remains active. It must now be reheard by a new judge at the High Court on Tuesday, December 31, 2024.

The ruling reinforces the judiciary’s critical role in ensuring electoral fairness and addressing procedural irregularities. Stakeholders in the affected constituencies await the High Court’s fresh deliberations with heightened anticipation.

The Supreme Court’s judgement has been lauded by the NDC as a step toward safeguarding electoral integrity and restoring confidence in the judicial process.
