Supreme Court Orders New Judge for 2024 Election Mandamus Case

Supreme Court fast-tracks election dispute resolution with new hearing deadline

The Supreme Court has ordered that a new High Court judge preside over the mandamus application concerning the disputed 2024 parliamentary election results.

This decision, issued on Friday, December 27, 2024, comes after the National Democratic Congress (NDC) filed an application challenging the initial handling of the recollation process.

The five-member panel, led by Justice Gabriel Pwamang, determined that the previous High Court judge had failed to allow a fair hearing for the NDC parliamentary candidates.

As a result, the Supreme Court has instructed that a new judge be assigned to the case.

In a bid to expedite the process, the court also abridged the filing timeline, giving parties just two days to respond.

“The time of filing is hereby abridged to two days from today. The applicants for mandamus in the High Court may respond to the processes of the interested parties,” Justice Pwamang added.

With time constraints imposed by the national electoral calendar, the Court set a deadline of Tuesday, December 31, 2024, for the hearing of the application.

Additionally, the Court quashed the recollation results from the Tema Central, Ablekuma North, Techiman South, and Okaikwei Central constituencies, which had been finalised on December 21, 2024. The decision raises questions about the validity of the parliamentary election results in these regions.

This move by the Supreme Court ensures that the ongoing election disputes are resolved quickly and fairly, ahead of the upcoming national electoral deadlines. With the hearing set to take place by December 31, all eyes are now on the new judge assigned to the case, as the legal process continues to unfold.
