Private legal practitioner Martin Kpebu has been released by the Office of the Special Prosecutor (OSP) after he was detained earlier on Wednesday, December 3, an unexpected development that temporarily stalled plans to interrogate him over corruption allegations he has levelled against Special Prosecutor Kissi Agyebeng.
Kpebu was released later in the evening after satisfying the bail conditions imposed on him.
According to sources familiar with the incident, the lawyer had arrived at the OSP for an official engagement with investigators but was taken into custody following a confrontation with police officers stationed at the entrance. His detention prevented investigators from beginning the scheduled questioning, as the Special Prosecutor could not proceed while he remained in police custody.

He was subsequently granted bail, which required a landed property in his name as security. However, a brief confusion arose when Kpebu could not immediately be located upon the return of his lawyer to finalise the process.
The episode adds to rising tensions between the outspoken lawyer and the Special Prosecutor. Kpebu has, in recent months, openly criticised the OSP’s handling of high-profile cases, accusing the office of procedural lapses, poor investigative structure, and relying on junior officers who report directly to the Special Prosecutor.
Last week, ahead of an earlier scheduled meeting at the OSP, Kpebu told journalists he would only participate in questioning if the investigation was conducted by an independently constituted committee. He argued that the current investigative arrangement compromised transparency, fairness, and institutional integrity.
He has also cited earlier grievances involving the handling of the inquiry into former Finance Minister Ken Ofori-Atta, maintaining that the OSP faltered on basic procedural standards in that matter as well.
As of Wednesday night, the OSP had not issued any public statement explaining the circumstances that led to Kpebu’s arrest, the nature of the confrontation at the gate, or the next steps regarding the corruption allegations.
Sources, however, suggest that investigators may reschedule the engagement now that the lawyer has been released.
The incident is expected to further fuel ongoing public debate about the operational independence, accountability mechanisms, and internal procedures of the OSP.
