Declare Kpandai Seat Vacant- Majority To Speaker Bagbin

The Majority Caucus in Parliament is pushing for the Speaker, Alban Bagbin, to declare the Kpandai parliamentary seat vacant after the Tamale High Court annulled the constituency’s 2024 parliamentary election results.

According to the caucus, the incumbent MP, Matthew Nyindam, must immediately step aside and cease participating in parliamentary business until a rerun of the election is conducted.

The majority argues that both the MP and Parliament have already been served with the court’s decision ordering a fresh poll after a legal challenge to the 2024 outcome. They insist that allowing Nyindam to continue taking part in proceedings undermines the authority of the court and established parliamentary precedent.

Rising on the floor of Parliament, Majority Chief Whip Rockson Nelson Dafeamekpor referenced previous instances where MPs stepped aside under similar circumstances, particularly the case of Assin North MP James Gyakye Quayson.

“Mr Speaker, I’m not raising these matters whimsically because precedent will guide us,” he said. “When the Honourable Gyakye Quayson was ordered by the court to go through a rerun, members of this side at the time spoke vociferously that he could not be entertained in this House. Eventually, he had to leave. This is a path we have travelled. Precedent has been set. Nobody can tell us today that Honourable Nyindam must have a voice. It won’t happen.”

But the minority is fiercely resisting the demand.

Speaking to journalists on Wednesday, November 26, Minority Leader Alexander Afenyo-Markin said the caucus would oppose any attempt to bar Nyindam from representing his constituents, arguing that all legal avenues must be fully exhausted before such action can be taken.

He maintained that the ruling does not automatically strip Nyindam of his status as MP until further judicial processes, including potential appeals, are completed.

The standoff sets the stage for another heated constitutional and procedural battle in Parliament as both sides dig in on their interpretation of the court’s ruling and its immediate implications for representation in Kpandai.
